1. The defendant shall pay 81,50,000 won to the plaintiff and 12% per annum from November 21, 2019 to the day of complete payment.
Reasons
1. The description of the grounds for the claim shall be as specified in the attached Form;
2. Judgment without holding any pleadings (Article 208 (3) 1 of the Civil Procedure Act);
3. The part on statutory interest rate under the main sentence of Article 3(1) of the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings for Partial Dismissal (amended by Presidential Decree No. 29768, May 21, 2019 and enforced June 1, 2019) and the part on which the Plaintiff’s delay damages claim exceeds the rate of 12% per annum under Article 2(2) of the Addenda is dismissed.
