The prosecution of this case against the defendant is dismissed.
1. Around 13:53 on January 31, 2020, the Defendant, at the 14th underground floor parking lot in the Seocho-gu Seoul Central District Court, the Seoul Central District Court registered the first floor of the Seoul Central District Court (14-ro, Seoul, 37-year old), took a mutual bath as a matter of movement of the victim B (Nam, 37-year old) and vehicle, and assaulted the victim’s knee part by driving car (C)
2. The above facts charged cannot be prosecuted against the victim's express intent under Article 260 (1) of the Criminal Act as a crime falling under Article 260 (3) of the Criminal Act. According to the records, etc. of the victim B who was submitted to this court on March 30, 2020 after the prosecution of this case, it can be recognized that the victim B withdraws his/her wish to punish the defendant around March 30, 2020. Thus, the prosecution against the defendant is dismissed pursuant to Article 327 (6) of the Criminal Procedure Act.
