1. The Defendant’s KRW 62,00,000 as well as the Plaintiff’s annual rate from April 5, 2018 to May 15, 2019.
1. Facts of recognition;
A. The status of the Defendant and D Co., Ltd. is a licensed real estate agent engaging in real estate brokerage business under the trade name of “E real estate,” and D Co., Ltd. (hereinafter “D”) is a company that newly constructs and sells a 482-household Gtel on the land other than the Seo-gu in Gwangju, Seo-gu and four lots (hereinafter “instant officetel”).
B. 1) D on March 23, 2012, 2012, H Co., Ltd. (former trade name: I Co., Ltd.; hereinafter “instant trust company”).
B) On March 23, 2012, and April 14, 2015, D entered into a contract with the instant trust company for sale and management (hereinafter “instant trust contract”) pursuant to the instant business agreement. On April 14, 2015, D completed the registration of ownership transfer on the ground of the instant trust company with respect to the instant officetel.
3. According to the above business agreement and the trust agreement of this case, the trust company of this case manages the ownership of the G building site and the ownership of the Gtel, and D carries out the sale business such as entering into the sale contract after consultation with the trust company of this case. The trust company of this case will deposit the sale contract, open the fund management account, and receive and manage the sale price. The sale revenue shall be collected only in the agricultural bank account in the name of the trust company of this case, which is the sale revenue management account designated by the trust company of this case. The sale contract of this case shall specify the above sale revenue management account and recognize only the amount deposited in the designated sale revenue management account as the sale price. The sale contract of this case shall not be valid without the seal of the trust company of this case, and the trust company of this case completed the registration of ownership transfer to the buyer who paid the sale price in full
