Defendants shall be punished by imprisonment for one year.
However, with respect to Defendant F, it shall be for 2 years from the date this judgment became final and conclusive.
Punishment of the crime
Defendant
A on November 30, 2010, sentenced eight months to imprisonment for a violation of the Game Industry Promotion Act by the Cheongju District Court, and completed the execution of the sentence in the Chungcheong House on June 25, 2011, and is the representative of the Jeonju District Court I, and the defendant F is the Jju District Office.
1. No person who violates the provisions of the petroleum and alternative fuel business through manufacture, sale and storage of fake petroleum shall manufacture, import or sell fake petroleum products or keep them knowing that he/she is fake petroleum products;
Nevertheless, the Defendants conspired with K, who is an employee of the above gas station from April 30, 2012 to June 14, 2012, manufactured fake petroleum products by mixing approximately 16,000 litres and lubrication 4,000 litres and selling them to many and unspecified vehicles who find the above gas station at approximately 8 to 7,200 litres, the minimum price per litres and 1,630 litres and 1,730 litres and the highest price per litres and 50,00 litres and 81,50,000 litres and 86,50,000 litres and the highest price per litres and 16,30,000 litres and the highest price per litres and 10,000 litres and the highest price per litres and 16,300,000 won for sale purposes.
As a result, in collusion with the above K, the Defendants manufactured and sold a total of KRW 81,50,000 liter market price of KRW 86,50,000, the highest price of KRW 86,500,000, and the highest price of KRW 10,000 liter market price of KRW 16,30,000, and the highest price of KRW 17,300,000, while knowing that they are fake petroleum products.
2. A petroleum retailer in violation of a petroleum or alternative fuel business by selling petroleum below the fixed quantity shall not install or remodel business facilities for the purpose of selling petroleum below the fixed quantity, or sell petroleum or alternative fuel below the fixed quantity;
Nevertheless, the Defendants, in collusion with K, who is an employee of the above gas station, in order to sell less than the fixed quantity around June 1, 2012.
