However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

1. 상해 피고인은 2016. 11. 22. 21:45 경 경북 칠곡군 B에 있는 C 앞 도로에서 대리 운전을 하는 D(39 세) 이 같은 대리 운전 기사를 차량에 태워 가기 위해 경적을 울리며 찾는 것을 피고인에게 경적을 울리는 것으로 오해하고 서로 시비를 하던 중 피해자가 “ 술 쳐 먹었으면 집에 가라 ”라고 반말을 한다는 이유로 양손으로 D의 멱살을 잡고 승용차 운전석 창문 안으로 D의 얼굴을 밀어 넣고, 손으로 D의 울대를 잡아 비틀고, 발로 몸을 수회 찼다.

피고 인은 위와 같이 피고인이 D을 폭행하는 것을 목격한 피해자 E(30 세) 이 피고인의 팔을 잡아당기며 싸움을 만류하자 이에 화가 나 손으로 피해자의 오른손 엄지손가락을 꺾고 오른손 주먹으로 피해자의 얼굴을 20여 회 가량 때리고, 발로 피해자의 얼굴과 몸을 수회 찼다.

As a result, the Defendant got a face-to-face in need of treatment for about 21 days to the victim.

2. For the same reasons as Paragraph 1, at the same time and place as Paragraph 1, the Defendant damaged property: (a) left the victim D and Si guard along a road with a diameter of 240,000 won at the market price he worn by the victim; and (b) continuously left the road with a diameter of 150,000 won at the market price on which the victim E was worn by the Defendant, as Paragraph 1, and (c) left the road with a diameter of 150,000 won at the market price on which the victim E was worn by the Defendant.

Accordingly, the defendant damaged and concealed the victims' property and harmed their utility.
