A defendant shall be punished by imprisonment for six months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Punishment of the crime
The Defendant is a person who is in charge of individual rehabilitation in the Seocho-gu Seoul Metropolitan Government’s office from December 2, 2005 to March 2008, from June 2009 to February 201, at the office of a certified judicial scrivener located in Gangdong-gu, at the office of a certified judicial scrivener located in Gangdong-gu Seoul, from February 201 to April 201, at the office of a certified judicial scrivener located in Gangdong-gu, from September 201 to June 201, and at the office of a certified judicial scrivener located in Gangdong-gu Seoul Metropolitan Government from September 2010 to June 201.
No one, other than an attorney-at-law, shall handle legal services, such as appraisal, representation, arbitration, settlement, solicitation, legal consultation, preparation of legal documents, etc., in connection with litigation cases, non-contentious cases, household conciliation, adjudication cases or other general legal cases, in return for promising to receive or promising to receive money, valuables, entertainment or other benefits or having a third party provide or promising to provide them.
Nevertheless, even though the defendant is not an attorney-at-law, the defendant accepted the case by providing publicity that he would deal with the cases such as rehabilitation and bankruptcy, and prepared an application, etc., and then submitted an application in the name of a certified judicial scrivener or attorney-at-law to the court.
Accordingly, on June 4, 2011, the defendant received 1 million won from the client I to request the handling of the case of personal bankruptcy and exemption from liability at the above F Certified Judicial Scriveners Office, and then prepares a petition for bankruptcy with I in the name of the certified judicial scrivener arranged by the above H, and submitted the above application to the Seoul Central District Court on August 4, 201.
In addition, the Defendant, from July 2010 to February 2015, handled approximately 45 legal affairs requested by 27 persons in total as shown in the annexed crime list.
