1. The Defendant shall pay to the Plaintiff KRW 50,00,000 and the interest rate of KRW 20% per annum from December 20, 2014 to the day of full payment.
Comprehensively taking account of the overall purport of the statements in Gap evidence Nos. 1, 2, and 6, the defendant borrowed money from the plaintiff by receiving KRW 50 million from the defendant's account of community credit cooperatives (900-1645-8243-0) on May 15, 2014 to establish a medical institution.
Therefore, the Defendant is obligated to pay to the Plaintiff damages for delay calculated at the rate of 20% per annum from December 20, 2014 to the day of complete payment, which is the day following the delivery of a copy of the complaint of this case. Thus, the Plaintiff’s claim of this case is reasonable and it is so decided as per Disposition with the assent of all participating Justices.
