피고인은 2011. 8. 4.경부터 2011. 8. 22.경까지 사이에 대구 달서구 C오락실‘에서, ’Ocean U Boat' 게임기 40대를 설치하여 게임장을 운영하는 D의 종업원으로 근무하였다. 위 ’Ocean U Boat' 게임기는 물위에서 떨어지는 폭뢰를 피하며 어뢰를 발사하여 물고기 및 적 잠수함을 잡는 방법으로 점수를 획득하고, 작동 레버의 조작 없이 단순히 발사 버튼만을 눌러서는 절대 고득점을 할 수 없도록 등급분류를 받았음에도 불구하고 등급분류를 받은 내용과 달리 위 게임기에 게임자동실행기인 ‘똑딱이'를 설치하고 시작버튼을 누르면 손님들의 능력과는 무관하게 게임이 자동으로 진행되고, 폭뢰 출현시간 및 출현빈도가 변경되었으며 거북이나 악어, 상어가 화면에 나타나면 2만점 내지 10만점의 고득점이 획득되도록 변조된 게임기인바, 피고인은 D과 함께 게임을 마친 손님들에게 획득한 점수에 해당하는 점수보관증을 교부하여 게임장 밖에 대기하던 성명을 알 수 없는 환전업자로 하여금 이를 현금으로 환전해 주도록 하였다.
