A defendant shall be punished by imprisonment for a term of one year and two months.
Seized Nos. 1, 2, 3, and 10 shall be returned to the victim C.
Punishment of the crime
On January 16, 2013, the Defendant was sentenced to eight months of imprisonment with prison labor at the Gwangju District Court for larceny, etc., and on February 14, 2013, the Defendant was sentenced to one year and two months of imprisonment with prison labor at the same court for the same offense, etc. and completed the execution of the sentence on August 10, 2014.
1. Larceny;
A. At around 01:00 on December 28, 2014, the Defendant: (a) discovered a GMW car in the parking lot located in Young-gu, Young-gun, Young-gu; and (b) opened an unrectable vehicle door and entered into the vehicle with the key located in the vehicle, and stolen the said vehicle by using the key located in the vehicle.
B. At around 02:00 on December 30, 2014, the Defendant: (a) opened and entered a door that was repaired at the location of the Canadian-gu Capital Company H; (b) and then cut off the sum of KRW 2,05,40,00 in the market price, including one Canadian-gu Capital Holdings, one direction-based one, two fluences of the victim, one fluor, one fluor, one fluor, and one fluor credit card (credit number K) of the National Bank.
2. Fraud and violation of the Specialized Credit Finance Business Act;
A. On December 30, 2014, around 03:18, the Defendant: (a) paid gas to the NAW car located in Seongbuk-gu, Sungnam-gu; (b) used the credit card in the name of the national bank in the above BMW as if the Defendant was a legitimate holder; and (c) paid the gasoline equivalent to KRW 60,000 to the said BM car, and paid the price by the said credit card.
B. On December 30, 2014, the Defendant, at the foregoing place, sold to the said BMW car, used the credit card in the name of the National Bank of Korea, which was stolen as above, as if the Defendant was a legitimate holder, unlawfully used the 30,000 won of gasoline for the said BM car, and paid the price by the said credit card.
Accordingly, the defendant shall obtain a total of 90,000 won from the victim M, and shall be obtained through two times.
