1. Defendant A
A. Violation of the Electronic Financial Transactions Act 1) The Defendant: (a) formed a corporation with no real entity (the so-called “YO corporation”; (b) opened an account under the name of the corporation; and (c) played the role of opening, delivering, and soliciting, by proxy, an account holder, who sells an account at a certain price in the criminal organization, such as an illegal sports earth site, etc.; and (c) performed the role of establishing, etc. the above-mentioned U.S. corporation while working with the Defendant; and (d) M, nameless N (hereinafter “N”) performed the role of opening, etc. an account by submitting documents of the above-mentioned corporation to the bank.
