The prosecution of this case is dismissed.

Reasons

1. On February 2, 2016, at around 00:40, the Defendant: (a) committed an assault against the victim C (35) who was a customer at the place of the Defendant’s seat, such as taking a bath at the packing end of the front package B in Gangnam-gu Seoul, Gangnam-gu, Seoul; and (b) assaulted the victim at his/her own seat with the victim’s right ear.

2. Determination

(a) Crimes of non-violation of intention (Article 260 (3) of the Criminal Act);

B. Withdrawal of wishing to punish the victim after the indictment of this case

C. Judgment dismissing public prosecution (Article 327 subparag. 6 of the Criminal Procedure Act)
