1. Basic facts

A. On September 7, 2015, the Plaintiff concluded a contract for the supply of goods and construction works (hereinafter “instant first construction contract”) with respect to the steel frame and steel bars among the Defendant C and the Plaintiff’s warehouse construction works (hereinafter “instant construction works”).

1. A project owner: The actual trade name of the Fund shall be stated in H or the aforesaid contract.

2. The name of the construction project: The name of the subcontracted project at the site of G construction in mountains-si: The steel frame and steel reinforcing work at the site of the plaintiff's warehouse;

4. Construction period: The contract price on October 5, 2015, which is completed on September 7, 2015, on the commencement of construction on September 7, 2015: The supply price of 104,000,000 won, value-added tax of 10,400,000 won: the contractee Defendant C (E) of the contractor for the work who entered into a contract with the contractor for a contract for a project: 3/100;

B. On September 14, 2015, the Plaintiff paid KRW 45,760,00 (including value-added tax; hereinafter the same shall apply) to Defendant C as down payment.

C. As seen earlier on September 20, 2015, the actual date of the instant secondary construction contract between H (hereinafter “H”) and Defendant B appears to be around November 16, 2015.

A contract for the supply of goods and construction works (hereinafter “instant secondary construction contract”) is concluded as follows.

2. The name of the construction project: The name of the subcontracted project at the site of G construction in mountains-si: The steel frame and steel reinforcing work at the site of the plaintiff's warehouse;

4. Construction period: The contract amount on September 20, 2015, completed on September 25, 2015, 2015: 10. Public order column: 3/100 of the construction contract amount in this case, Defendant B, the contractor, and the guarantor, affix their seal impressions on the right side between the contractor’s column and the guarantor’s column, and Defendant D’s seal impressions on the right side.

Although the location of the Defendant D’s seal affixed is also the number of days indicated above as the guarantor’s column, in light of the background leading up to the preparation of the above contract, name of the guarantor’s column, resident registration number, etc., the Defendant.
