임대차보증금
1. The Defendants jointly pay KRW 100 million to the Plaintiff 12% per annum from June 13, 2019 to the date of complete payment.
1. The facts under the basis of facts do not conflict between the parties, or may be acknowledged by taking into account the overall purport of the pleadings as a whole in the entries in Gap evidence 1 to 4 (including branch numbers).
D obtained permission for the new construction of the building listed in the separate sheet (hereinafter “instant building”) on July 25, 2005 (the building owner appears to have been changed from October 11, 2005 to D, E, and F) (the new construction commenced on October 28, 2005 and obtained approval for the use of the instant building on April 8, 2008 (the building owner appears to have been changed to D and G before obtaining approval for the use) and on August 6, 2009, registration for the preservation of ownership was completed in D and G name with respect to the instant building on August 6, 2009.
B. On January 4, 2010, H organization completed the registration of creation of a new mortgage on the instant building with the maximum debt amount of KRW 2.4 billion and the debtor I, and thereafter, on May 15, 2013, the auction procedure was initiated regarding the instant building to Daejeon District Court Seosan Branch K on the application of the JJ Co., Ltd., the mortgagee, and the Defendant B Partnership Co., Ltd (hereinafter “Defendant Partnership”) purchased the instant building on July 22, 2015 during the said voluntary auction procedure.
C. Meanwhile, on May 10, 2006, the Plaintiff, an attorney-at-law whose business registration was completed with the trade name “Attorney A-at-Law Office” as of May 10, 2006, when the said voluntary auction procedure was in progress, completed the said lease registration on May 29, 2015 with respect to the building of this case as of October 27, 2005, the lease deposit amount of KRW 100,000,000, the lease deposit date, and the date of business registration, May 10, 2006, the three floors of the building of this case, the whole floor of the building of this case, the possessor, and the date of commencement of the business registration date of May 1, 2006, and the lease registration was completed on May 29, 2015.
A defendant partnership corporation shall be the defendant corporation on July 11, 2016 with respect to the share of 259.34/778.02 of the building in this case due to sale and purchase (hereinafter “sale in this case”).
