1. The plaintiff (Counterclaim defendant)'s main claim is dismissed.
2. The Plaintiff (Counterclaim Defendant) is the Defendant (Counterclaim Plaintiff) with KRW 4,103,40.
A principal lawsuit and a counterclaim shall be deemed simultaneously.
Basic Facts
A. B Co., Ltd. (hereinafter “B”) is a company that constructs an aggregate building of the size of the first and fifth floors above the ground level C underground at Council-si (hereinafter “instant building”) and sells part of its section for exclusive use.
B. On May 6, 2013, the Plaintiff entered into a contract under which B and B entrusted the Plaintiff with the management of the instant building to manage the instant building (hereinafter “instant management contract”). The main contents are as follows.
Article 5 (Period of Management Contract) (A) The management period under this Agreement shall be two years from June 1, 2013.
The term "A" (referring to "B"; hereinafter the same shall apply) shall be extended to the same period under the same conditions unless a written notice of cancellation of contract is given two months before the expiration of the period.
(b) “A” or “B” (referring to the Plaintiff; hereinafter the same shall apply) shall be extended in the absence of a written notice of the renewal of this Agreement not later than 30 days before the expiry of the term of validity of this Agreement under the same conditions as before.
Article 6 (A) All sectional owners shall move into the management office after paying KRW 10,000 per square meter as at the time of registration of transfer of ownership.
(b) The management expenses for athletes shall be managed and operated by “B” on behalf of “A”, and shall be operated for advance payment, such as general management expenses, public charges, and facility maintenance expenses, and for replacement for attempted management expenses.
(C) When the sectional owner is changed, transfer between the parties to the trade shall be made.
C. On October 29, 2015, the sectional owners of the instant building, including B, publicly announced the convocation of an extraordinary general meeting on November 5, 2015, on the agenda of the composition and management body of the instant building, the election of managers, and the enactment of regulations.
Accordingly, at the extraordinary general meeting held on November 5, 2015 (hereinafter “instant general meeting”), a management body was organized and a resolution was passed to appoint D as the manager was made.
