1. In the case of Suwon District Court's Sung-nam Branch B real estate auction, C (Dual) real estate auction, the above court on January 2015.
1. Basic facts
가. 소외 D 소유의 광주시 E 외 7필지 부동산 및 그 지상 건물(이하 이를 통틀어 ‘이 사건 부동산’이라고 한다)에 관하여 2009. 9. 18. 채권최고액 6,786,000,000원, 근저당권자 주식회사 세람상호저축은행으로 된 근저당권(이하 ‘이 사건 근저당권’이라고 한다)이 설정되었고, 2013. 6. 24. 위 근저당권이 피담보채권 양도를 원인으로 하여 주식회사 골프앤죠이 명의로 이전되고 이어 같은 날 위 근저당권에 관하여 채권자 주식회사 세람상호저축은행, 채권액 6,786,000,000원으로 된 질권이 설정되었다.
B. On January 17, 2014, Spoi Mutual Savings Bank Co., Ltd. filed an application for a voluntary auction of real estate rent B with the Suwon District Court Sungnam Branch as to the instant real estate, and subsequently another creditor received a decision to commence the compulsory auction of real estate in duplicate C by the said court.
(C) The procedure following each of the above decisions on commencing the auction (hereinafter “instant auction procedure”).
During the instant auction procedure, Sejong Mutual Savings Bank transferred the right to collateral security and the secured debt established on the instant real estate to the Plaintiff, and notified the obligor of the secured debt of this case.
In the auction procedure of this case, the Defendant submitted a lease agreement, etc. on April 27, 2012, stating that part of the real estate of this case is leased at KRW 23 million from D when he applied for a demand for distribution as a small lessee under the Commercial Building Lease Protection Act.
E. In the instant auction procedure, the auction court distributed KRW 7,500,000, out of the amount to be actually distributed on April 23, 2015, to the Defendant, who is a small lessee, one in the order of priority. 6,221,294,962, the auction court drafted a distribution schedule that distributes KRW 6,221,294,962 to the applicant creditor and the Plaintiff, the pledgee, in the order of priority (hereinafter “instant distribution schedule”).
