1. The defendant shall be punished by imprisonment for one year;
2.Provided, That the execution of the above sentence shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Punishment of the crime
"2016 Highest 631"
1. A crime committed on January 14, 2016;
A. On January 14, 2016, at around 16:00, the Defendant: (a) intruded a structure; (b) intruded into a new container stuff office in Busan Shipping Daegu D; and (c) intruded into the victim E’s garment, using an unresh door; and (d) stolen the victim’s Samsung Credit Card Co., Ltd. and one copy of the Busan Bank Cze Card.
B. On January 14, 2016, at around 16:28, the Defendant in violation of the Act on Financial Business Specializing in Fraud and Credit, by suggesting the victim to the third party as if the Defendant was the ownership of the Defendant, in purchasing two of the victims G in Busan Shipping Daegu F, and at around 18K EM 1, the Defendant accused the victim by suggesting the Busan Bank C&C card which was stolen, as in paragraph 1(a), and then by deceiving the victim by acquiring the stolen C&C card from the victim’s owner to receive KRW 580,000,000 at the market price of both of the victims, and using the stolen C&C card.
2. A crime on February 5, 2016;
A. On February 5, 2016, around 05:5, the Defendant: (a) intruded into “K” operated by the Victim J, located in Busan-gu, Busan-do; and (b) intruded into “K” through a corrected window; and (c) by having one of the two keys owned by the victim on his/her book, one of the two keys was stolen.
B. On February 5, 2016, around 06:00, the Defendant: (a) driven a MF5 car that was set up at a stolen vehicle key, such as paragraph (2) of the same Article, using the key to the vehicle that was stolen as paragraph (1) of the same Article; and (b) stolen the amount equivalent to KRW 5,00,000 at the market price of the MF5 car owned by the victim J.
3. On February 22, 2016, the Defendant, at around 22:22:20 on February 22, 2016, intruded into the “N restaurant,” operated by the victim M in Suwon-gu L, Busan, through an unrecepted window, and stolen the Defendant, holding the victim’s Samsung Emt North Korea’s market value amounting to KRW 1,00,000, cash amounting to KRW 20,000.
