The defendant is not a person handling narcotics.

1. 피고인은 2013. 7. 27. 01:00경 중국 광저우 깡뻬이루에 있는 상호 불상의 호텔에서, C 등과 함께 번갈아가면서 물병에 물을 약 반 정도 채우고 병마개에 구멍 2개를 낸 다음, 한 구멍에는 빨대를 물에 잠기지 않게 꽂고 다른 한 구멍에는 빨대를 물에 잠기게 꽂은 후, 그 물에 잠긴 빨대에 유리관을 꽂고 나서 그 유리관에 D 등으로부터 건네받은 향정신성의약품인 메트암페타민(일명 ‘필로폰’, 이하 ‘필로폰’이라 함) 약 0.03g을 넣고 그 밑을 가열한 다음, 물에 잠기지 않은 빨대를 흡입하여 물을 통과한 그 연기를 들이마시는 방법으로 필로폰을 투약하였다.

4. The Defendant, at the time, at the same time and place as the above 3. Paragraph 3., and together with C, 3g of philophones purchased as set forth in the above 2.

Accordingly, the defendant provided philophones in collusion with C.

5. Around August 11, 2013, the Defendant entered China as the Republic of Korea, and received communication from D, who was in custody of approximately 11 gramphones in lieu of 11g of philophones purchased as set forth in the foregoing paragraph 2, to send the same quantity of philophones through a person holding philophones in the Republic of Korea.

After that, on August 2013, the Defendant was around the Gan Bank, D, etc. located in the Gangnam-gu Seoul, Gangnam-gu.
