A. The sentence imposed by the prosecutor (eight months of imprisonment, two years of suspended execution) is too unfilled and unfair.

B. Although the Defendant did not inflict bodily injury on the victim as stated in the facts charged, the lower court accepted this part of the facts charged and convicted the Defendant. In so doing, the lower court erred by misapprehending the facts, thereby affecting the conclusion of the judgment.

2. Determination

A. The following circumstances acknowledged by the evidence duly adopted and examined by the court below as to the defendant's assertion of mistake of facts, i.e., (i) the victim has been consistently stated from the investigative agency to the court of the court below that the victim was her son at the time of her son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son.
