The court's explanation of this case is the same as the part of the reasoning of the judgment of the court of first instance, and thus, citing this case in accordance with the main sentence of Article 420 of the Civil Procedure Act.
(1) The Plaintiff’s appeal is dismissed in its entirety as it is so decided as per Disposition by the assent of all participating Justices, on the ground that the testimony of H by the witness of the trial at the trial as shown in the Plaintiff’s assertion is not affected by the fact-finding or judgment of the first instance court because it is difficult to believe that the testimony by the witness of the trial at the trial as shown in part of the Plaintiff’s assertion.
