[2] Although the Defendants did not have the right to issue a payment guarantee certificate, Defendant A and B did not have the right to issue a payment guarantee certificate, Defendant A prepared a form of a payment guarantee directly, and Defendant A conspired to deliver a payment guarantee certificate in the name of G Co., Ltd. by forging a payment guarantee certificate in the name of G Co., Ltd., as if the Plaintiff was the executive director of G Co., Ltd., a guarantor.

1. On January 21, 2014, Defendant B forged Private Document: (a) indicated the “issuance Number: I”; (b) “Issuance Date: January 21, 2014; Guarantee Agency”; (c) “Guarantee Agency: Guarantee Company: Seoul Headquarters of G Co., Ltd; (d) “Defendant W Co., Ltd.”; and (c) “this payment of KRW 00,000,000,000;” and (d) the Defendant was aware of the trade name near the Seocho-gu Seoul alternate Station; and (e) sealed the employee identification of Defendant A, as above, on the guarantor, amount guaranteed, and claim amount of the said payment guarantee.

Accordingly, the Defendants forged a letter of payment guarantee in the name of the Seoul Headquarters of G Co., Ltd., a private document related to rights and obligations for the purpose of uttering in collusion.

2. On February 2014, the Defendants issued a forged payment guarantee letter as above to J as if it were a document duly formed, and issued the said payment guarantee letter as if it was genuine to an employee, who could not know the name of the Defendants, through N in the office of Tae Young Steel located in 1083 at the Seocho-si in Gwangju City, as the 27 February 2014 of the said J, H, K, L, M, M, and N, and issued it as if it was genuine to complete the said payment guarantee certificate for the purpose of a security document.

As a result, the Defendants conspired in the name of the Seoul Headquarters.
