A is the representative director of K, who runs franchise business from around December 26, 201, and from around August 201, in Gangnam-gu Seoul, Defendant B, from around December 13, 2013, in Ulsan-gu M, Defendant C, from around January 6, 2014, in Jongno-gu, Seoul Jongno-gu N, and Defendant D, from around February 24, 2014, in the name of " Q" from around September 2009 to around September 24, 201, in which Defendant C operates a beef selling restaurant.

A person who sells or provides agricultural and fishery products or the processed products thereof after cooking shall not place a false label of origin (including the hacker meat) or make a false label likely to cause confusion as to such products.

Nevertheless, the Defendants, using the following facts: (a) in the case of domestic beef and beef, there is a difference between approximately 4-5 times the price of Chinese milk and mil milk, and (b) the general public is not aware of the kind of cattle, such as Korean milk, cattle, and milch cattle, in the case of domestic products; and (c) when cooking and selling the mil milk with a low price, the Defendants intended to cause confusion as if they were selling the mil milk, and sell the mil milk meat with a method of inserting the contents of “hermil milk, etc.” on the mil.

1. The sole criminal conduct of Defendant A;

A. From December 2013 to March 7, 2014, the Defendant violated the Act on Origin Labeling of Agricultural and Fishery Products: (a) from the point of origin to the point of origin; (b) from the restaurant of " Q" of approximately 33 square meters operated by himself/herself on the first floor of the building underground of Gangnam-gu Seoul, Seoul; (c) from the point of refrown land in Gwanak-gu, Seoul Special Metropolitan City, approximately 5382 km of the milch meat amounting to about 48 million won at the market price; and (d) after being supplied with approximately 5382 km of the milbling machine in Seoul Special Metropolitan City, it was cooked and sold as "the old fracks, fracks, and so on" and indicated a false and confusion with the origin of the car tag attached to the above restaurant.
