The Defendant, even though he was aware that he was an officer of the commission of the crime of telephone financing fraud (hereinafter “Sphishing”), accepted the above proposal with the intention of having the Defendant receive the Defendant’s request for recovery and delivery of the money for daily allowances from the person without his name to the Defendant using the “D” phishing case, and to facilitate the said Bophishing crime.

On April 10, 2018, 12:20 on or around 12:20, 200, the Defendant misrepresented F Bank staff by phone calls from the victim E’s cell phone at a non-displace, and falsely speaks that “When he/she obtains a bank loan in the name of Nei, and redeems the loan in several times, he/she may improve credit if he/she has repaid the loan in several times, and upon the improvement of credit rating, he/she would have a loan in a low interest rate of up to 40 million won.” Accordingly, he/she received KRW 6 million from the victim to the F Bank account in the name of G on April 12, 2018, and received KRW 6 million from the victim, and received KRW 6 million from the victim’s bank account in the name of G on the same day on April 16, 2018.

On April 17, 2018, the Defendant: (a) received instructions from a person who was unable to receive his name; (b) sent shopping bags containing KRW 10 million in cash from the employees of the Bank at the front of Dongdaemun-gu Seoul, Dongdaemun-gu I; and (c) transferred the shopping bags to the exit No. 418, a 418-ro, Singu, Sinung-si; and (d) delivered a name-free delivery book to the name-free delivery book on two occasions on April 18, 2018, after receiving the shopping bags containing KRW 6.8 million from the victim in cash from the victim in the front of the Dongdaemun-gu Seoul, Dongdaemun-gu I road, Seoul; and (c) delivered KRW 16.8 million in total over two occasions, such as moving 1 or 2 times in the king-ro No. 418-ro, Singu, Gyeonggi-gu, to the name-free delivery book.

Accordingly, the defendant could easily commit the crime of fraud of a person without a name.
