1. Since July 7, 2011, the Defendant had a dispute over the ownership of the ginseng in the name of the member of the cooperative in terms of the planned area of the cooperative members and the current status of the ownership of the cultivated land managed by the Daibuk Ginseng Farming Cooperative, the Defendant, from around July 7, 201, filed a lawsuit, such as verification of the ownership of D and ginseng, and sold the ginseng distribution of 150 million won in price to H around December 2, 201, for the ginseng distribution outside of 17 lots, and for the ginseng distribution outside of 17 lots, and for the ginseng distribution outside of 10 million won, from around April 2009, the Defendant was unable to pay wages and retirement allowances to the workers of the ginseng field cultivated by himself from January 18, 2012.

The Defendant did not notify the victim I of the fact that the lawsuit is in progress due to the dispute over the ownership of the above ginseng, and the said F and G Ginseng Korea was difficult to offer it as a collateral due to the above circumstances, and even if he borrowed money from the victim I, despite the absence of the intent or ability to normally repay, on February 29, 2012, the Defendant received from the victim I a false statement to the effect that “I would provide the victim I with the voice-gun E and one other than one, the petitioner-gun, the F. 17, the petitioner-gun, and the Sim-gun, and the 20,00,000,000,000 won, from the victim I, at the law firm office located in Seo-gu, Chungcheongnam-gu, Chungcheongnam-gu, Seoul, Seoul, as a collateral for transfer.” In the case of the borrowed money, the Defendant received from the victim I a false statement to the effect that “I would enter into a transfer contract with the maturity of February 19, 2012.”

On April 2012, the Defendant continued to provide the Victim I with additional security on three and five parcels, including Jincheon-gun, J, and Audio-gun, the name of the wife, and five lots of ginseng dry field, both of which, by September 30, 2012, to the victim I, “on the other hand, if he/she lends the money, he/she will pay the money together with the borrowed money by September 16, 2012,” and the same year.
