Reasons

Comprehensively taking account of the purport of each statement in Gap evidence Nos. 1 through 3, the plaintiff engaged in meat sales business supplied pigs meat, etc. up to April 20, 2015 in trading with the defendant who runs the retail business of livestock products, and it can be acknowledged that the price of the goods unpaid by the defendant constitutes 27,182,343 won and the amount of the goods unpaid by the defendant constitutes 27,182,343 won. Thus, the defendant is obligated to pay to the plaintiff damages for delay calculated at each rate of 6% per annum under the Commercial Act from April 21, 2015 to July 16, 2015, when it is evident that the delivery date of the payment order in this case is the date of the payment order in this case, and 15% per annum under the Act on Special Cases concerning the Promotion, etc. of Legal Proceedings from the next day to the day of full payment.
