A defendant shall be punished by imprisonment for two years.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Reasons

Punishment of the crime

1. At around 00:30 on October 30, 2019, the quasi-Robbery Defendant: (a) opened a back door of the front of Dobong-gu Seoul Metropolitan Government B Apartment; (b) opened the front door of the said taxi while leaving the front door of the said taxi in order to shut down the bus; (c) the Defendant was trying to take a driver’s seat in order to cut off the said taxi whose market price is not known to the victim; (d) opened a door of the said taxi in front of Dobong-gu Seoul Metropolitan Government B apartment; and (e) opened a door of the said taxi in order to escape arrest, and opened a door of the said taxi in order to escape arrest.

Accordingly, the defendant abused the victim's property and assaulted the victim for the purpose of evading arrest.

2. A person who is engaged in the business of driving a Dok in violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Bodily Injury) and the Road Traffic Act, and the accused in violation of the Road Traffic Act;

The Defendant driven the said taxi while under influence of 0.131% of alcohol content at the time and place specified in paragraph (1) above, and driven the said taxi to 3rd direction from the right side of the opposite bridge.
