[2015 Highest 765] The Defendant was aware of the fact that the victim D had built and resided in a building without the consent of E on the 1562m2m2 in Seosan-si, Seosan-si, which is owned by E, and was able to obtain the said land from the victim, thereby raising awareness of the fact that the victim D had obtained the said land.

1. On December 5, 2012, the Defendant prepared a private document for qualification conspiracy: “A”, in the seller’s column, stated “A”, in the seller’s agent column “B”, in the seller’s agent column “B”, in the buyer’s agent column “B”, in the buyer’s agent column “A”, in the buyer’s agent column “A”, in the buyer’s agent column, and in the buyer’s agent column “A”, in the buyer’s agent column “A”, the buyer’s agent column.

However, there was no fact that the defendant purchased the above land from E, and there was no fact that he was delegated the power of representation concerning the sale of the above land.

Accordingly, for the purpose of exercising, the Defendant drafted a chapter of the Real Estate Sale Contract, which is a private document on rights and obligations, by gathering the qualification of agent of E.

2. The Defendant, at the time and place specified in Paragraph 1, exercised a private document as if it were a document that duly formed a real estate transaction agreement, which was prepared with qualification ambiguous as above, to D, who was aware of such qualification qualification.

3. The fraud accused purchased this land from E at the date, time, place, etc. described in paragraph 1, “The Defendant purchased this land in which she is living,” to the victim.

If so, it will be sold to others.

"Abreging the horses," and concluded a real estate sales contract with the victim who believed that he/she would be an agent of E as above.

However, the defendant did not purchase the above land from E as well as the fact that he purchased it.
