Criminal facts
피고인은 2016. 3. 14. 23:15 경 경남 고성군 B에 있는 C 식당 앞 노상에서, ‘ 누가 내 아들 차를 끌고 가는 것을 잡아 놨다’ 는 112 신고를 받고 현장에 출동한 고성 경찰서 D 지구대 소속 경위 E, 순경 F로부터 귀가 제의를 받자, 신고자에게 시비를 걸려고 하고, 이에 위 경찰관들 로부터 제지 당하자, ‘ 야 이 씹할 놈들 아. 개새끼야. 호로 새끼야 ’라고 욕설을 하면서 손으로 위 E의 가슴 부위를 3회 밀치고 멱살을 잡아 흔들며, 옆에서 만류하던 위 F의 가슴 부위를 손으로 밀치는 등 폭행하였다.
Accordingly, the defendant interfered with the legitimate execution of duties by the police officers on the 112 reporting handling duty.

- A favorable circumstances: The defendant appears to be a contingent crime in a state of drinking, the defendant does not want to punish the defendant, the defendant reflects his/her mistake in depth, the defendant does not have any criminal record of the same kind, and he/she does not have any criminal record of the past 15 years.
In light of the sentencing conditions of Article 51 of the Criminal Act, such as the Defendant’s age, sex, environment, and circumstances after the commission of the crime, even if there are no particular criminal records, and it seems somewhat harsh to select imprisonment immediately with prison labor for the mistake of the Defendant who agreed with the victimized police officers.
