1. The Defendant’s KRW 338,789,836 as well as the Plaintiff’s annual rate of 6% from May 1, 2014 to July 27, 2015, and the following.
From November 26, 2013 to April 30, 2014, the Plaintiff supplied the Defendant with raw materials and equipment equivalent to the total amount of KRW 435,259,836,00,000, which was not paid in full by the Defendant, and the Plaintiff was supplied with “amount for subdivision” equivalent to the total amount of KRW 210,485,000 from the Defendant. Of the above, KRW 55,00,000,00,000 on January 29, 2014, was paid respectively on May 20, 2014, and there is no dispute between the parties.
In addition to the above facts acknowledged, the Plaintiff requested the Defendant to pay only the remaining 338,789,836 won (435,259,836 won - 96,470,000 won) calculated by deducting the amount for the share payment from the above amount of 435,259,836 won, such as the unpaid raw materials, from the amount of 46,470,00 won. Thus, the Defendant is obligated to pay the Plaintiff the above 338,789,836 won and its interest rate of 6% from May 1, 2014 to July 27, 2015, the delivery date of the original copy of the payment order of this case, and from the following day to September 30, 2015, the provisions of the main sentence of Article 35 of the Act on Special Cases Concerning Expedition etc. of Legal Proceedings (amended by Presidential Decree No. 26535, Sep. 25, 2015).
Therefore, the plaintiff's claim of this case is justified and it is so decided as per Disposition.
