1. Basic facts

A. The Plaintiff is a company with the objective of developing technologies through rainwater, waste water reuse treatment, simplification of technology development through wastewater treatment process, environmental management and technology consulting business. The Defendant is a company with the purpose of manufacturing, installing and operating environmental facilities, manufacturing, installing and operating food waste treatment plants, waste collection and transportation business, interim waste disposal business, waste recycling and treatment business, and comprehensive waste disposal business, etc.

B. On May 12, 2011, the Defendant concluded a consignment service contract with the effect that the contract amount is KRW 259,200,000 for the entrusted operation of livestock wastewater and compost facilities owned by the noble livestock farming association (hereinafter “the instant livestock wastewater treatment facilities”) (the disposal volume of livestock wastewater 9,600 cubic meters/years, the unit disposal price of the treatment volume of 27,000 cubic meters/metres 27,000 cubic meters/metres 9,600 cubic meterss of annual treatment volume exceeding 9,600 cubic meters), the contract period from May 11, 2011 to July 31, 2016 (the normal operation from August 1, 2011, excluding the period of the repair of facilities), and other matters are decided in accordance with the above consignment agreement.
