The defendant shall pay 3,487,706 won to the plaintiff and 20% per annum from April 5, 2019 to the day of complete payment.
Reasons
Comprehensively taking account of the purport of Gap evidence No. 1’s entries and arguments, the Plaintiff retired from office in “C” operated by the Defendant from May 2, 2011 to March 21, 2019, and the Plaintiff did not receive wages of KRW 21,300,000 and retirement allowances of KRW 12,187,706 from August 2, 2018 to March 2019.
Therefore, the defendant is obligated to pay to the plaintiff 3,487,706 won and damages for delay calculated at the rate of 20% per annum as stipulated in the Labor Standards Act from April 5, 2019 to the date of full payment after 14 days from the date of retirement of the plaintiff.
