The prosecutor's appeal is dismissed.
1. The summary of the grounds for appeal in the judgment of the court below (including fine of KRW 3,00,000, and completion of sexual assault treatment programs 40 hours) is deemed to be too uneasible and unfair.
2. The prosecutor's assertion is without merit, since the judgment of the court below is reasonable in light of the following: the defendant's recognition of and reflects on the crime of this case; the defendant has no record of criminal punishment; and all other matters concerning the sentencing specified in the records and arguments of this case.
3. Therefore, the prosecutor's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act on the grounds that the appeal is without merit. It is so decided as per Disposition.
