1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

Reasons

1. The Plaintiff is the owner of Gangnam-gu Seoul Metropolitan Government Cdong (hereinafter referred to as “Cdong”) 311 square meters (hereinafter referred to as “instant site”) for D site. The Defendant is the owner of B Park 1,879.7 square meters (hereinafter referred to as “instant park”) adjacent to the instant site, and there is no dispute between the parties.

2. 원고의 주장 이 사건 대지는 별지 도면 기재와 같이 E 지상 F 빌딩, 이 사건 공원, G 아파트, H 지상 다가구주택, I 지상 J호텔 등으로 둘러싸여 있는 맹지로서 이 사건 대지에서 공로에 출입할 수 있는 유일한 방법은 건축물이 없는 이 사건 공원을 통하는 방법 밖에 없으므로, 원고에게는 민법 제219조에 기하여 이 사건 공원 중 별지 도면 표시 ㉠, ㉡, ㉢, ㉣, ㉠의 각 점을 순차로 연결한 선내 ‘가’부분에 대하여 통행할 권리가 있고, 피고는 원고의 위 ‘가’부분 92.24㎡의 통행에 방해가 되는 장애물을 설치하거나 기타 통행에 방해가 되는 일체의 행위를 하여서는 아니 된다.

3. Determination

A. The following facts may be acknowledged in full view of the descriptions of evidence No. 1 and the purport of the entire pleadings, and there is no reflective evidence.

1) On August 22, 200, K purchased E large 1,036.4 square meters, and on January 9, 2001, K completed the registration of the transfer of the entire co-owner’s share in its own name. 2) on January 17, 2001, K merged Lba 319.8 square meters owned by it on E’s land, and after the merger on January 31, 2001, K divided E large 1,356.2 square meters into E large 1,35.2 square meters and 311 square meters of the instant land, and after the division on April 23, 2003, it newly constructed neighborhood living facilities and business facilities on E’s land.

3. After that, on September 1, 2009, K sold the instant site to third parties, including M, etc., and the Plaintiff acquired the ownership by winning the instant site at a voluntary auction procedure on July 22, 2016.

(b) Where the landowner has constructed a building having contributed to a piece of land or to a public road, the surrounding land shall be owned by another person;
