A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Punishment of the crime
The defendant is a person who is engaged in driving a Brane car.
At around 00:40 on December 24, 2014, the Defendant driven the above vehicle while under the influence of alcohol content of 0.105%, and, at around 00:40 on December 24, 2014, three lanes in front of the Yongsan Park located in 151, as Dongdaemun-gu Seoul, Dongdaemun-gu, Seoul, the Defendant proceeded to approximately 50 kilometers in the speed of Sin-do as the epologic epolog.
At the time, since the defendant tried to change the course to two lanes, there was a duty of care to prevent accidents by changing the course safely so as not to impede the normal passage of the room in order to change the direction and the left and right of the driver.
Nevertheless, the Defendant, while under the influence of alcohol, went through two-lanes of the Victim C (year 54) driving in the same direction as mail by negligence in the course of business, was driven by the Defendant, and the front front part of the driver’s seat of the Plaintiff’s E(age 58) driving of the said passenger taxi and the rear part of the driver’s seat of the victim’s E(age 58) stopping on the right-hand three-lane, and received the back part of the driver’s seat of the victim’s E(age 58) driving that was parked on the right-hand three-lane.
As a result, the Defendant: (a) caused the above victims C to take care of light finites, etc. requiring approximately two weeks of medical treatment; (b) light salt finites, etc., requiring approximately two weeks of medical treatment; and (c) caused the said victims E to incur approximately KRW 3,142,78 of repair cost; and (d) damaged the said victims’ personal taxi to take care of KRW 807,928 of repair cost.
However, the defendant immediately stopped and escaped without taking measures such as providing relief to victims, removing risks and obstacles on the road, and ensuring smooth traffic conditions.
