Any person who intends to manufacture electrical appliances subject to safety certification as a business or manufacture them in any foreign country and export them to the Republic of Korea without obtaining safety certification shall obtain safety certification from any safety certification institution, as prescribed by Ordinance of the Ministry of Trade, Industry and Energy.
The Defendant was equipped with facilities to manufacture electric wires and electrical appliances (such as cable board, extension line, etc.) at the same place of business, and decided to manufacture electric wires and electrical appliances without obtaining safety certification.
On July 22, 2013, the Defendant manufactured “(i) 30M” electrical appliances, other than the specifications for which safety certification is not possible, and (ii) manufactured electric wires and electrical appliances, other than specifications for which safety certification is not possible, without obtaining safety certification equivalent to KRW 103,282,179, and (iii) more than 31 times, as indicated in the attached crime sight list Nos. 1 through 31.
(b) No person who has affixed the safety certification mark, etc. to any electrical appliances subject to safety certification and their packaging and has not been exempted from safety certification or has not undergone the safety inspection shall place the safety certification mark, etc. or any similar mark on the electrical appliances subject to safety certification
Nevertheless, around July 22, 2013, the Defendant manufactured “JH0510101”, which is an electrical appliance outside the specifications, without obtaining any safety certification at the same place of business, and used a similar mark with the safety certification mark for 31 times, as indicated in the attached Table Nos. 1 through 31, without obtaining any safety certification.
