1. The Defendant shall pay to the Plaintiff KRW 52,515,400 and interest rate of KRW 15% per annum from January 6, 2018 to the date of complete payment.
According to the evidence Nos. 1-1, 2, 3-1, 2, and 3-1, 3-1, 2, the Plaintiff sold agricultural products equivalent to KRW 126,515,40 in total to the Defendant from September 1, 2017 to October 31, 2017. However, it is recognized that the Defendant paid KRW 74,515,000 out of the purchase price of agricultural products. The Defendant is obligated to pay to the Plaintiff damages for delay calculated at the rate of KRW 15% per annum under the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings, etc. from January 6, 2018 to the date of full payment.
As to this, the defendant alleged that the plaintiff suspended the payment of the non-paid agricultural products due to the defendant's poor sales, but there is no evidence to acknowledge this.
The plaintiff's claim of this case is justified.
