In light of the above, the court below's sentencing is acceptable in full view of the following facts: (a) the elderly defendant is in a difficult situation where the current health is not good (the disabled class 6 and the basic livelihood recipient); and (b) the latter part of Article 37 of the Criminal Act has a criminal record of concurrent crimes; (c) however, the victim's letter is not yet available for repeated defraudation; and (d) other conditions of sentencing under Article 51 of the Criminal Act are equally taken into account; and (e) the defendant's assertion is unreasonable.

3. In conclusion, the defendant's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act since it is without merit. It is so decided as per Disposition.
