【Criminal Facts】

1. Fraud;

A. On May 17, 2013, the Defendant: (a) around 03:00 on May 17, 2013, 2013, issued orders for food of KRW 23,000 in total from the victim’s place of residence, on the following grounds: (b) the Defendant was not a valid means of settlement, such as cash or credit card in his/her possession at the time; and (c) even if he/she was supplied with food from the victim, he/she did not have the intent or ability to pay the price; and (d) the Defendant received food of KRW 23,00 in total from the victim’s place of residence.

Accordingly, the defendant was given property by deceiving the victim.

C. On July 18, 2013, the Defendant received food from the victim on July 18, 2013 due to the lack of effective means of payment, such as cash or credit card in his/her possession at the time, from the victim J, around 00:30 on July 18, 2013.
