1. The Defendant shall pay to the Plaintiff KRW 200,000,000 as well as 30% per annum from October 21, 2016 to the date of full payment.
The Plaintiff loaned KRW 100,00 on July 26, 201 to the Defendant on July 26, 201, at the rate of 18% per annum, and at the rate of overdue interest rate of 36% per annum. On August 31, 2010, KRW 10,000 on August 31, 201 shall be the due date of payment, interest rate of 18% per annum, and overdue interest rate of 36% per annum. The fact that the Defendant paid to the Plaintiff the interest of KRW 200,000 per annum by October 20, 201 is no dispute between the parties.
Therefore, the Defendant is obligated to pay to the Plaintiff damages for delay at the rate of 20 million won per annum under Article 2(1) of the former Interest Limitation Act (amended by Act No. 12227, Jan. 14, 2014) and Article 2(1) of the former Interest Limitation Act (amended by Presidential Decree No. 25376, Jun. 11, 2014) within the scope of the interest rate in arrears from October 21, 2016 to the date of payment of the Defendant’s final interest payment to the Plaintiff.
Therefore, the plaintiff's claim of this case is reasonable, and it is so decided as per Disposition by admitting it.
