1. The Defendant shall pay to the Plaintiff KRW 44,329,411 and interest rate of KRW 20% per annum from August 22, 2015 to the day of complete payment.
The Plaintiff provided labor under employment by the Defendant from October 22, 2012 to August 7, 2015, and the Defendant did not pay 89,329,411 won to the Plaintiff, including wages, retirement allowances, unpaid annual allowances, and other money and valuables, and the Defendant paid 45,00,000 won out of the above money on November 5, 2015 does not conflict between the parties.
According to the above facts of recognition, the Defendant is obligated to pay the Plaintiff the amount of 44,329,411 won (=89,329,411 won-45,000 won) such as the unpaid wages, etc. and delay damages calculated at the rate of 20% per annum from August 22, 2015 to the date of full payment, which is the day following the 14th day after the date when the Plaintiff finally provided labor.
Therefore, the plaintiff's claim shall be accepted on the grounds of its reasoning, and it is so decided as per Disposition.
