The prosecution of this case is dismissed.
1. Around 08:40 on January 11, 2020, the Defendant: (a) 08:40 on the part of the Defendant, at the “C cafeteria” located in Busan Shipping Daegu; and (b) on the ground that the Victim D (year 51) and drinking alcohol were inflicted on the Victim’s assault, the Defendant saw the Victim’s face in his arms and her drinking.
2. The judgment of the court below is a crime that cannot be prosecuted against the victim’s clear and intentional intent pursuant to Article 260(3) of the Criminal Act. According to the records, the victim expressed his/her intention not to prosecute the defendant after the prosecution of this case. Thus, the prosecution of this case is dismissed pursuant to Article 327 subparag. 6 of the Criminal Procedure Act.
