1. The Defendant’s KRW 300,000,000 as well as the Plaintiff’s annual interest from June 18, 2010 to October 27, 2017.
1. The fact that the Plaintiff loaned a total of KRW 400,400,000 to the Defendant from January 21, 2009 to August 27, 2009, and that the Defendant agreed to pay the Plaintiff the principal of KRW 400,000 to the Plaintiff on May 17, 2010 does not conflict between the parties.
According to the above facts of recognition, the defendant is obligated to pay to the plaintiff 300,000,000 won among the above agreed amount of 400,000,000 won and damages for delay calculated at each rate of 5% per annum as stipulated in the Civil Act from June 18, 2010 to October 27, 2017, on which the original copy of the payment order of this case was served, and 15% per annum as stipulated in the Act on Special Cases concerning Expedition, etc. of Legal Proceedings from the next day to the day of full payment.
2. It is so decided as per Disposition by the assent of all participating Justices, on the ground that the plaintiff's claim of this case is reasonable.
