1. Details of the disposition;
A. The Intervenor joining the Intervenor (hereinafter referred to as the “ Intervenor”) is a housing reconstruction project partnership aimed at implementing a housing reconstruction project by setting the total area of 246,208.3 square meters in the area of rearrangement zone (hereinafter referred to as “instant rearrangement zone”) with the aggregate of 234,34.9 square meters in Gangdong-gu Seoul Metropolitan Government D (hereinafter referred to as “D”) E, F, G, H TW B B B 234,344.9 square meters and the area of 11,863 square meters in J. 1,863.4 square meters in the area of rearrangement zone, and the Plaintiff (appointed party; hereinafter referred to as “Plaintiff”) and the designated parties are owners of land
B. The Gangdong-gu Seoul Metropolitan Government Promotion Committee for the Establishment of B Apartment Housing Reconstruction Project (hereinafter “instant Promotion Committee”) which is a telegraph of the intervenor association, filed an application for approval to establish the Promotion Committee with the head of Gangdong-gu Seoul Metropolitan Government (hereinafter “Gangdong-gu head”) for the purpose of implementing the housing reconstruction project with respect to B comprised of 71 apartment units and 7 ancillary and welfare facilities. The head of Gangdong-gu Office approved the establishment of the Promotion Committee on October 27, 2003 by deeming that the instant Promotion Committee obtained the consent of 2,695 total owners of lands, etc. located in E, F, G, HJ B B B 234,344.9 square meters (hereinafter “previous project area”).
C. From around 2006, the instant promotion committee sought consent to establish an association from the owners of lands, etc. in the previous business area. On November 25, 2006, the inaugural general meeting was held to resolve the issues such as “cases of the resolution to establish a housing reconstruction project association and the consent to implement the project,” “cases of the establishment of the articles of association and the operational rules,” “cases of the partnership’s officers (association presidents, directors, auditors), and representatives’ election.”
On February 21, 2009, owners of lands, etc. in J held a residents' general meeting on February 21, 2009 and passed a resolution on the merger or reconstruction with B and J with the consent of 142 of the total owners of lands, etc. in the above complex by 176.
E. After that, the council of occupants' representatives of J apartment reconstruction will be reconstructed to the head of Gangdong-gu on March 9, 2009.
