2. Determination

(a) Applicable provisions of Acts: Article 109(1) and Article 36 of the Labor Standards Act, Article 44 Subparag. 1 and Article 9 of the Guarantee of Workers' Retirement Benefits Act, Article 40 of the Criminal Act, Article 44 Subparag. 1 and Article 9 of the Guarantee of Workers' Retirement Benefits Act;

(b) Crimes of non-violation of will: Article 109(2) of the Labor Standards Act, proviso to Article 44 of the Guarantee of Workers' Retirement Benefits Act.

(c) Declaration of non-existence of punishment: Submission of a statement of withdrawal of complaint on October 16, 2019 that no punishment for each of the defendants is sought on November 7, 2019, after the institution of the instant case.

(d) Judgment dismissing public prosecution: Article 327 subparagraph 6 of the Criminal Procedure Act;
