기공료
1. The Defendant shall pay to the Plaintiff KRW 42,130,90 and the interest rate of KRW 15% per annum from October 21, 2017 to the day of full payment.
From May 8, 2017 to September 29, 2017, the Plaintiff supplied dental technicians, such as dental care, to the Defendant. The fact that the amount of the goods unpaid by the Defendant as of the date of the closing of argument in the instant case is 42,130,900 is no dispute between the parties. Accordingly, according to the above fact of recognition, the Defendant is obligated to pay to the Plaintiff the amount of the goods unpaid to the Plaintiff at the rate of 42,130,90 won and 15% per annum under the Act on Special Cases concerning the Promotion, etc. of Legal Proceedings, which is the day following the delivery of the original copy of the instant payment order, as sought by the Plaintiff.
As to this, the defendant asserts that since the plaintiff and the defendant agreed to pay the price of goods in installments from the month following the delivery date, it cannot be paid in lump sum. However, there is no evidence to acknowledge this, the defendant's above assertion cannot be accepted without the need to examine other points.
Therefore, the plaintiff's claim of this case is justified and it is so decided as per Disposition.
