1. The Defendant (Counterclaim Plaintiff) paid KRW 26,675,00 to the Plaintiff (Counterclaim Defendant) for KRW 26,675,00 and for this, from January 10, 2013 to January 21, 2014.
1. The facts below the underlying facts are either in dispute between the parties or in accordance with Gap evidence of 1 to 17, 20 to 22 (including paper numbers, hereinafter the same shall apply), Eul evidence of 2 to 11, and 19 to 22, and witness C's testimony of the witness C, and there is no counter-proof otherwise.
The Plaintiff is a licensed real estate agent who operates the F Licensed Real Estate Agent Office located in Songpa-gu Seoul Metropolitan Government E Commercial Price (hereinafter referred to as "E Commercial Price") and engages in real estate brokerage business, etc.
B. (1) On December 29, 201, the Defendant, under the Plaintiff’s brokerage, leased KRW 10, 111, 113, 115, 116, 117, 118, 145, 146, and 147 (hereinafter “10 stores”) in the Non-Party New Bank Co., Ltd. (hereinafter “New Bank”), a total of KRW 2,900,000, KRW 300,000, KRW 300,000, KRW 3000, KRW 300,000, KRW 3000, KRW 3000, KRW 3000,000, KRW 3000, KRW 3000,000, KRW 5000, KRW 5005, KRW 2005, KRW 5000, KRW 50005, KRW 1005,005.
(2) In addition to 109, 109-1, and 112-3 stores under the Plaintiff’s intermediary, the new bank leased 3.6 billion won (i.e., the above KRW 2.9 billion), monthly rent of KRW 30,000 (i.e., the above KRW 19,50,000 KRW 10,500,500), around December 29, 201.
On April 10, 2012, the Plaintiff issued a tax invoice claiming the amount of KRW 18,150,000 (i.e., the amount of KRW 16,50,000 for the supply price of KRW 16,50,000) for the said 13 stores (the said 10 stores, 110, 109, 109-1, and 112-3 stores), and received the said KRW 18,150,000 from the new bank on April 16, 2012. On July 8, 2012, the Plaintiff received the said KRW 18,150,000 from the new bank. The said KRW 1/2 of the brokerage commission for the said 13 stores, 18,150,000 for the supply price = 16,500 for the supply price of KRW 16,500.
