1. The amount remaining after selling the E site of Yeongdeungpo-gu Seoul Metropolitan Government to auction and deducting the auction expenses from the price;
1. Facts of recognition;
A. On May 21, 2007, the Plaintiff completed each registration of ownership transfer on the shares of 98.5/224 of the land among the shares of 1,2,3,4,5,6,7,8,9, and the shares of 98.5/224 of the Yeongdeungpo-gu Seoul Metropolitan Government E Site (referring to the attached Table 1 and the attached Table 1 and each of the indications on the attached map; hereinafter “instant land”); and on the shares of 1,2,3,4,5,6,7,8,9, and 24 of the above land (the building indication on the register is “Seoul Yeongdeungpo-gu E wood and the 44.79 square meters of the 1st floor of the 1st floor neighborhood living facilities”; hereinafter “Plaintiff’s housing”). < Amended by Presidential Decree No. 12740, Mar. 20, 1988>
B. On June 30, 2006, the Defendant completed each registration of ownership transfer on the instant land on the ground of sale on June 5, 2006, with respect to the remaining share of 125.5/224 shares, excluding the shares owned by the said Plaintiff, and the above land-based wooden machine and branch roof multi-story housing (the building indication on the register is “Seoul Yeongdeungpo-gu EF heading light and 43.80 square meters of multi-story housing; hereinafter “Defendant’s housing”).
C. On the ground of the instant land, Nonparty G had a house for which the registration of ownership transfer was completed on October 16, 1959 (the building indication on the register is referred to as “Seoul Yeongdeungpo-gu E H heading and Y H H heading 7 mar sap sap sap sap sap sap sap sap sap sap sap sap sap sap 19p 7 mp 7 mp sap sap sap sap sap sap sp sp sp sp sp sp sp sp sp sp sp sp s
At present, the current status of the Plaintiff’s housing includes the part “A” and “D.” indicated in the attached reference 1, and the current status of the Defendant’s housing is “B” indicated in the same drawings, and the current status of the Nonparty’s housing is “A” indicated in the same drawings.
The defendant uses both parts, ① and ② together.
E. On the other hand, the boundary of the instant land is abutting on the road (Seoul Yeongdeungpo-gu I road), as shown in the attached Table 6, 7 only connecting each point of the above drawings.
