1. The Defendant shall pay to the Plaintiff KRW 17,267,688 and the interest rate of KRW 20% per annum from October 1, 2016 to the day of complete payment.
The Plaintiff was employed by the Defendant who operates the advertisement preparation business, etc., and retired from office by providing labor from office from January 11, 1996 to September 3, 2015. The Defendant did not pay KRW 30,917,690 in total to the Plaintiff as of September 3, 2015 and paid KRW 21,817,690 in total to the Plaintiff as of September 3, 2015. The Defendant paid KRW 9 million in total to the Plaintiff five times during the period from May 31, 2016 to September 30, 2016. The interest calculated by the interest rate for delay payment under the Labor Standards Act, the principal amount of unpaid wages and retirement allowances as of September 30, 2016, and there is no dispute between the parties.
According to the above facts, the Defendant is obligated to pay the Plaintiff wages and retirement allowances of KRW 17,267,688 and delay damages calculated at the rate of 20% per annum under the Labor Standards Act from October 1, 2016 to the date of full payment.
If so, the plaintiff's claim is justified and accepted.
