According to the evidence submitted by the prosecutor, the defendant should be found to have stolen the victim's bank and clothing as stated in the facts charged, but the judgment of the court below which acquitted the defendant.

2. According to the reasoning of the lower judgment, the lower court acquitted the Defendant of the instant facts charged on the grounds that it is difficult to recognize the Defendant’s deception or deception on the grounds as stated in its reasoning.

In light of the records, the above judgment of the court below is just and acceptable, and there is no error of law by mistake of facts as alleged by the prosecutor.

3. Therefore, the prosecutor's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act on the grounds that the appeal is without merit. It is so decided as per Disposition.
