[Criminal Power] Defendant A was sentenced to one year of imprisonment with labor for a violation of the Wastes Control Act at the District Court on November 16, 2018, and the judgment became final and conclusive on January 16, 2019.

【Criminal Facts】

No person shall dump wastes in any place other than a place or facility prepared by the head of a Si/Gun/Gu to collect wastes, and any person who intends to operate a waste treatment business shall obtain permission from the competent authority.

1. From February 28, 2018 to May 2, 2018, Defendants A, who committed a crime of dumping approximately KRW 2742 tons of commercial wastes on the land outside the Gyeonggi-do Seocheon-si, Gyeonggi-do (hereinafter “instant land”), was ordered to take measures regarding waste disposal from the side of the Macheon-gun, Seocheon-do (hereinafter “instant land”) to remove part of the instant land to the land of KRW 1,653 square meters (hereinafter “instant land”), which Defendant B leased the instant land to the Defendant around May 19, 2018 and intended to allow the shipment of waste by leasing it to the Defendant KRW 10 million.

Accordingly, from May 2018 to August 22, 2018, Defendant A discarded approximately 300 tons of waste, among the waste dumped in the instant land, by using a vehicle with a 5 tons E, not a place prepared by the Y from May 2018 to August 22, 2018. Defendant B continued to allow the introduction of waste.

As a result, the Defendants conspired to commit the illegal dumping of industrial wastes outside the designated place.

2. Defendant B, without obtaining permission from the competent authorities for waste treatment business, had a person carry wastes into the instant land from May 2, 2018 to August 22, 2018, as described in paragraph (1), and managed the carried-in wastes under the condition that he/she received KRW 2 million per month from A, and carried them into the vehicles listed in paragraph (1), and brought them into the chemical, military, and household waste treatment facilities.
