The judgment below

In light of the records, the court below, on the grounds stated in its reasoning, reversed the part of the judgment of the court of first instance and acquitted the Defendants on the grounds that all of the facts charged in this case against the Defendants did not prove a crime, while maintaining the acquittal portion in the judgment of the court of first instance is just, and contrary to what is alleged in the grounds of appeal, the court below did not err by exceeding the bounds of free evaluation of evidence against logical and empirical rules.

On the other hand, the prosecutor appealed against the entire judgment of the court below, but the charge of assaulting Defendant B among the facts charged in this case does not indicate the grounds of appeal or the reasons of appeal.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
